After years of heated debate over Drug Enforcement Agency (DEA) telemedicine restrictions, supporters and detractors of telehealth prescriptions will be heard in a public listening session. The telehealth community welcomes the news after over a decade of struggle dealing with telemedicine prescription writing over state lines.
DEA Telemedicine Background
The DEA telemedicine public listening session is the first substantial advancement since the February 24, 2023, announcement of proposed permanent rules following the end of the Public Health Emergency caused by COVID-19. The core issue being debated is whether patients receiving prescriptions over state lines should be required to have an in-person session with the prescriber. The DEA has held firm in its reluctance to release telemedicine privileges to protect the consumer public since the passage of the Ryan Haight Act in 2008. The act was initially implemented to regulate companies that have been too lax with telemedicine prescriptions of controlled substances with potentially lethal consequences. Multiple sides of the issue have surfaced over the ensuing 15 years.

Public Listening Session
The Drug Enforcement Administration (DEA) will conduct public listening sessions to solicit input from healthcare practitioners, experts, advocates, patients, and other stakeholders on the regulations governing prescribing controlled substances via telemedicine. These insights will inform the DEA’s future policy-making in this area.
Both in-person attendance and remote participation via live stream will be available for these sessions.

The DEA will reportedly accommodate requests for limited oral presentations during the sessions. Individuals wishing to present (either in person or virtually) must indicate their intent when registering. Please note that presentations will be capped at 10 minutes each.
